This article highlights a 2001 U.S. Supreme Court case, NLRB v. Kentucky River and its aftermath. In Kentucky River, the Supreme Court rejected the National Labor Relations Board?s interpretation of the National Labor Relations Act (NLRA), which for years has allowed professionals, including physicians, to collectively bargain despite the fact they could be excluded as a manager or ?supervisor? under the statutory language of the NLRA. This decision has diminished interest in physician unions, which soared a decade ago.
